The International Covenant on Civil and Political Rights has a provision that permits an interpretation that affirming a “distinction” between foreigners with respect to political rights, and on the other hand, with respect to the regulation of “hate speech” required by the provisions of the International Convention on the Elimination of All Forms of Racial Discrimination, the Japanese government has held back from the beginning of the ratification of the Convention, claiming that there is a problem in relation to the freedom of expression in the Constitution of Japan （Article 21）.
