A very large number of scholars of the Constitution of Japan purport that the notion of “human rights” contained in it corresponds to “natural rights” in Christian Sense. Yet, in Japan, Christian population is less than that following Buddhist and/or Shinto beliefs, as well as the large proportion of people who claim no religious affiliation. For this reason, most people in Japan would not be convinced with this explanation of the human rights. This article reconsiders the notion of “the protection of human rights” contained in the Constitution of Japan by taking the perspectives offered in Hofeldian thinking, as it pertains to systems of human rights protection.}, pages = {77--112}, title = {人権総論体系再考}, volume = {42}, year = {2021}, yomi = {サトウ, ジュンイチ} }
